Wholesale Terms and Conditions

Effective October 1, 2026

These terms apply to every Always With Us wholesale account. You agree to them when you check the box on the wholesale application, and they apply to every order you place. We may update them by posting a new version on this page, and we will email active accounts when something material changes.

1. Who can hold an account

Wholesale accounts are for businesses with a physical location, premises, or established in-person service that sells to end customers. Funeral homes, crematoriums, cemeteries, memorial dealers, gift shops, florists, hospices, grief centres, celebrants, veterinary practices, and pet aftercare providers all qualify.

You must be in the United States or Canada, hold whatever licence or resale permit your business requires, and be buying stock to resell, not for personal use and not to sell on to other resellers.

We review every application and may approve, decline, or close an account at our discretion. Accounts do not transfer if your business changes hands.

2. Pricing and orders

30% off published retail on orders of 1 to 5 items. 40% off on 6 or more. The count is every unit in your cart added together, across all products and sizes. There is no minimum order.

All orders are prepaid at checkout. Prices exclude tax and shipping and may change without notice. Wholesale pricing is confidential and cannot be combined with retail promotions or discount codes.

We fulfil domestically. United States accounts ship from a United States warehouse, Canadian accounts ship from a Canadian warehouse, and your delivery address must be in the same country as your account. Shipping times and costs are in our Shipping Policy.

3. Where you can sell

You may sell Always With Us products through:

• your physical store, showroom, funeral home, chapel, clinic, or premises;
• in-person meetings, arrangement conferences, at-need and pre-need consultations, and home, hospice, or facility visits;
• trade shows, markets, fairs, memorial events, and community events;
• printed catalogues, price lists, and print advertising;
• orders taken by telephone, email, SMS, or written quote; and
• your own website or app, on a domain you own, trading under your own business name, where you are the seller of record and you ship from your own stock.

4. Where you cannot sell

You may not sell, list, offer, or fulfil Always With Us products on any third-party marketplace or platform-run storefront.

This includes Amazon (including Seller Central, Vendor Central, and any Amazon storefront), eBay, Etsy, Walmart Marketplace, Wayfair, Target Plus, Overstock, Temu, Shein, Alibaba, AliExpress, Mercari, Poshmark, Wish, Newegg, Houzz, and Faire, together with any equivalent or successor platform. It also includes Facebook Shops, Facebook Marketplace, Instagram Shopping, TikTok Shop, Pinterest Shopping, WhatsApp catalogue checkout, YouTube Shopping, and live-shopping platforms, plus auction, classified, group-buying, flash sale, daily deal, subscription box, and liquidation sites.

It covers the indirect routes too. You may not use any app, feed, connector, or listing tool that syncs our products onto those platforms, and you may not use marketplace fulfilment such as Amazon FBA or Walmart Fulfillment Services, even where the listing itself sits somewhere else.

Selling online is fine. Selling on a marketplace is not. On those platforms identical listings compete on price alone and the platform, not you, owns the customer.

You also may not supply our products to any other reseller, wholesaler, distributor, liquidator, or exporter, and you may not drop-ship. Take stock, hold it, and sell it yourself.

If you want an exception to any part of this section, ask us. We grant them in writing, to one account at a time, and we can withdraw them on notice.

5. Minimum advertised price

The minimum advertised price (MAP) for each product is the retail price shown for that product on alwayswithus.co. There is no separate MAP list. If our website price changes, the MAP changes with it.

You may not advertise, display, or publish a price below MAP anywhere a member of the public can see it. That includes shelf tags and signage, print advertising and catalogues, your website at every stage of the purchase flow including the cart and the checkout page, Google Shopping and other product feeds, social media, email, SMS, and paid advertising.

A publicly available discount code, a site-wide or category sale that includes our products, a coupon, a rebate, or a free add-on item counts as advertising below MAP if it brings the visible price under MAP. Free or discounted shipping, delivery, engraving, personalisation, and gift wrap do not, as long as the displayed product price stays at or above MAP.

What you actually charge is your decision. MAP governs advertised prices only. You are free to sell below MAP in a price agreed in person, by telephone, or in an individual written quote, in a rate held behind a login for a defined group such as clergy, veterans, members, or hardship cases, or in an adjustment or credit given to a customer after a sale. Nothing in these terms requires you to sell at any particular price.

In accordance with the Competition Act (Canada), any retail price we publish or suggest is a suggestion only. Products may be sold at a lower price. You are under no obligation to accept a suggested resale price, and your business relations with us will not suffer as a result of the price at which you actually sell.

If we find advertising below MAP we will tell you and ask you to correct it within 5 business days. If it is not corrected, or breaches recur, we may stop accepting your orders or close your account. We do not charge fines, penalties, or clawbacks for a MAP breach.

6. Our brand

While your account is in good standing you may use our name, logo, and approved product photography to advertise and sell products you have bought from us.

Do not alter or crop our logo or photography, imply a partnership, agency, or exclusive appointment beyond stating that you are an authorised retailer, register any trademark, business name, domain, or social handle containing "Always With Us", or bid on our brand name as a keyword in paid search or paid social. This permission ends when your account does.

7. Non-exclusive

Your account is non-exclusive. We may approve other retailers anywhere, including close to you, and we sell directly to consumers through our own website at prices we set.

8. Returns, warranty and liability

Report any shortage, wrong item, or transit damage within 7 days of delivery, with your order number and photographs. Defect claims can be made within 30 days of delivery.

Otherwise wholesale orders are final sale. We do not accept returns for overstock, change of mind, or slow-moving inventory. Where we accept a claim we will replace the products or credit or refund what you paid, at our option, and that is your only remedy. Beyond that we give no other warranty, express or implied.

Our total liability on any order will not exceed what you paid for it, and we are not liable for lost profits or other indirect losses. You are responsible for your own customers, including their returns, refunds, and service, and for any claim you make about our products that we have not published or approved in writing.

9. Ending the relationship

Either of us can end the relationship at any time on written notice. We may suspend your account immediately if we reasonably believe you have breached section 4 or section 5, given us false information, or had a payment fail or reverse.

After your account ends you may sell through the stock you already hold for 90 days, still following sections 4, 5, and 6.

10. Law

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. The courts of Ontario, sitting in Ottawa, have exclusive jurisdiction.
